General Terms and Conditions (GTC) of Empyrean Travel Accessories

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed via the website of Empyrean Travel Accessories (hereinafter "Empyrean"). The offer on this website is exclusively directed at consumers residing in Switzerland (hereinafter "Customer").

A consumer is defined as any natural person who maintains business relationships with Empyrean that cannot be attributed to their commercial or self-employed professional activity. Empyrean reserves the right to reject orders in non-household quantities without justification.

Empyrean may amend these GTC at any time. The version valid at the time of the order shall apply. Customer terms and conditions that conflict with or deviate from these GTC are not recognized.

3. Prices

All prices displayed on the website are final prices in Swiss francs (CHF) and include statutory VAT and any other applicable fees (e.g., advance recycling fees or copyright levies), unless stated otherwise.

Shipping costs, if applicable, will be charged separately and are displayed during the checkout process.

Empyrean reserves the right to change prices at any time without prior notice. Sales prices do not include consulting or support services unless explicitly stated.

4. Contract Conclusion

The product offerings and prices on this website do not constitute legally binding offers but serve as an invitation for the Customer to submit an offer (order).

By placing an order, including accepting these GTC, the Customer submits a legally binding offer to conclude a purchase contract. Empyrean will confirm receipt of the order via email. This confirmation does not constitute acceptance of the contract.

The contract is deemed concluded once Empyrean explicitly accepts the order by sending an email confirmation of dispatch. Until this point, Empyrean reserves the right to refuse an order without stating reasons.

Orders will only be shipped after full payment has been received (except for purchases on account). If the ordered products are unavailable, Empyrean may cancel or partially fulfill the order, informing the Customer accordingly. In such cases, any payments already made will be refunded.

5. Payment Terms and Retention of Title

The available payment methods are displayed during checkout. Empyrean reserves the right to exclude certain payment methods or require advance payment without justification.

In the event of late payment, Empyrean may charge interest of 5% per year and a reminder fee of up to CHF 20 per reminder.

Until full payment is received, the delivered products remain the property of Empyrean.

6. Delivery, Inspection, and Returns

6.1 Delivery

Deliveries are made to the shipping address provided by the Customer. Empyrean strives for short delivery times, but any stated delivery dates are non-binding. Partial deliveries are permitted.

If a delivery is undeliverable due to incorrect address details or the Customer’s failure to accept the shipment, Empyrean may cancel the contract after setting a reasonable deadline and charge any incurred costs.

6.2 Obligation to Inspect and Report Defects

The Customer must inspect the delivered goods immediately upon receipt and report any defects covered by the warranty in writing (email or letter) within 7 days.

6.3 Returns

Returns are at the Customer’s expense and risk. Items must be returned in their original packaging, complete with all accessories, and include the delivery note and a detailed defect description. If a defect is not covered under the manufacturer’s warranty, Empyrean may charge inspection and return costs.

7. Right of Withdrawal

7.1 Withdrawal Period

The Customer has the right to withdraw from the contract within 14 calendar days of receiving the goods without stating reasons. The withdrawal must be declared in writing (email or letter).

7.2 Return Process

The Customer must return the goods within 10 calendar days after withdrawal, in their original condition and packaging, including all accessories and the delivery note. The return is at the Customer’s expense and risk.

7.3 Refunds

Once Empyrean receives the returned goods in satisfactory condition, any payments already made will be refunded within 20 calendar days. If the product is damaged or shows signs of excessive wear, Empyrean reserves the right to deduct an appropriate compensation amount from the refund.

8. Warranty

Empyrean provides a two-year warranty from the delivery date for products that have defects not caused by improper handling. Empyrean will, at its discretion, provide a repair, replacement, or refund.

The warranty does not cover normal wear and tear, improper use, or damage caused by third parties. Consumable parts (e.g., batteries) are excluded from the warranty.

9. Liability

Empyrean excludes any liability for direct or indirect damages, including lost profits, except in cases of gross negligence or unlawful intent where liability is mandatory under Swiss law.

10. Data Protection

Empyrean processes personal data in accordance with Swiss data protection laws. Detailed information can be found in the Privacy Policy on our website.

11. Governing Law and Jurisdiction

These GTC are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for any disputes is Zurich, unless legally required otherwise.
